YEAR WARRANTY

SIEGRIST and ASSOCIATES, INC. HEREBY CALLED SIEGRIST PROHOME WARRANTS THAT ALL WORK PURSUANT TO THIS CONTRACT SHALL BE OF WORKMANLIKE QUALITY AND SHALL BE IN ACCORDANCE WITH ALL APPLICABLE BUILDING AND PAINTING AND DECORATING CONTRACTORS OF AMERICA (PDCA) CODES PROVIDED THE OWNER IS IN FULL COMPLIANCE WITH THIS CONTRACT AND ITS PAYMENT PROVISIONS. SIEGRIST PROHOME SHALL REMEDY ANY DEFECT DUE TO FAULTY MATERIALS OR WORKMANSHIP WHICH APPEAR WITHIN A PERIOD OF ONE (1) YEAR FROM THE DATE OF COMPLETION. WITH RESPECT TO MATERIALS, ANY WARRANTY PROVIDED BY MANUFACTURERS WILL BE PROVIDED TO THE OWNER.

This warranty constitutes the sole and exclusive warranty made by the contractor. There are no other warranties, including but not limited to the implied warranty of merchantability and warranty of fitness for a particular purpose. And all such warranties are expressly excluded by the parties. This warranty also constitutes the owner’s exclusive remedy against SIEGRIST PROHOME including any alleged negligence. SIEGRIST PROHOME shall not be liable for any incidental or consequential damages, including liquidated, delay or other damages.
